Acceptance of Terms

By accessing or using VibePico at https://vibepico.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

VibePico is operated by Xhorizon Labs LLC, a Wyoming limited liability company ("VibePico", "we", "us" or "our"). These Terms are an agreement between you and Xhorizon Labs LLC.

Description of Service

We provide a software-as-a-service platform for AI image and video creation. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

Payment and Billing

Paid features are billed in advance for the selected billing period. You are responsible for providing accurate billing information. Refunds are handled on a case-by-case basis in line with our refund policy.

On the website, one-time credit packs can be bought with or without a subscription. Pack credits are valid for 365 days from purchase and are spent after credits that expire sooner. Prices and pack sizes are shown on the Pricing page.

In the iOS app, purchases are processed through Apple In-App Purchase. Store prices, included credits and billing periods are shown before purchase. iOS top-up credit packs do not expire; subscription credits expire at the end of the applicable billing period. Subscriptions renew automatically unless canceled in your Apple account subscription settings. Manage cancellations and refund requests through Apple. Deleting your VibePico account does not cancel an Apple subscription. Restore Purchases applies to eligible subscriptions; consumable credit packs cannot be restored.

Right of Withdrawal (EU/EEA Consumers)

If you buy as a consumer living in the EU or EEA, you have a statutory right of withdrawal.

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded. To exercise it, inform us (Xhorizon Labs LLC, 30 N Gould St Ste R, Sheridan, WY 82801, USA, email: contact@vibepico.com) of your decision by a clear statement, such as an email. You may use the model withdrawal form below, but it is not obligatory. It is enough to send your notice before the withdrawal period expires.

Effects of withdrawal. If you withdraw, we reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed of your decision. We use the same means of payment you used for the original transaction, unless you have expressly agreed otherwise, and you will not incur any fees for the reimbursement. If you requested that services begin during the withdrawal period, you pay us an amount in proportion to what has been provided until you informed us of your withdrawal, compared with the full coverage of the contract.

Loss of the right for digital content. For digital content not supplied on a tangible medium (on VibePico, credits added to your account), the right of withdrawal ends once we have begun performance after you (1) expressly consented to performance starting before the withdrawal period ends, (2) acknowledged that you thereby lose your right of withdrawal, and (3) received confirmation of the contract. You give this consent and acknowledgement with a checkbox before payment, and the confirmation comes with your email receipt. Credits are added right after a successful payment.

Our Refund Policy applies in addition.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may close your account at any time through your account settings.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
